      See our privacy notice A DAD who grew a cannabis crop in his loft has walked free from jail just two months into his ten month prison sentence because his partner is too sick to look after herself. Tony Abbott was sent to prison for ten months in late May after a £8,000 Class B drug farm was uncovered by police at his home in East Dam Wood in Speke. The 26-year-old had 32 plants on January 30, but only 14 of them were "viable," Lady Justice Thirlwall told London's Appeal Court today. The judge that sentenced Abbot at Liverpool Crown Court earlier this year could not have foreseen the circumstances during the next couple of months, the High Court ruled, with the defendant's partner's condition getting worse. She has a "serious heart condition" and is finding it "extremely difficult" to care for herself and their son, they said. She suffers from a rare syndrome affecting the operation of her heart and had unsuccessful surgery in December 2017. Another bout of surgery, due shortly after Abbott was sentenced, was expected to improve her condition. But in a written update to the court, his partner explained that "unfortunately that has not proved to be the case". The Appeal Court heard she is still suffering from serious symptoms including palpitations, dizziness and light-headedness. She struggles with her breathing and looking after herself as well as the couple's 'lively' 11-month-old son. Abbott's crime led to them losing their family home and she has moved in with her parents, the court heard. But they have used up all their annual leave in order to help her and are now at back at work during the day. Abbott said his cannabis plants were for personal use and any extra to be given to friends. He was not running a commercial enterprise, it was added. Abbott's previous convictions included cocaine possession and being concerned in the supply of a controlled drug. His lawyers did not challenge the 10-month jail term but argued it should have been suspended.   The new information "affects our view of the sentence", added the judge, who was sitting with two others. It was decided Abbott's jail term "is in fact having a significant harmful impact upon his partner directly, and indirectly on the welfare of the couple's child". "For that reason, and that reason only, we are prepared to allow this appeal," the judge ruled.       It looks like a early damaged stem that as healed. Maybe bent by watering earlier when it was small. Damaged cell's surrounded by healthy to fix the damage that have no place to go. It looks like it could cause problems later. My advice is simple. Cover it with rooting hormone and put a bottomless bucket over it and fill with wet soil. It will shoot roots out of the damaged part and remove the risk of pm spores infecting it later.
