Subject: CHICHESTER CROWN COURT 16TH JANUARY 2004

This is my court report based on my notes taken in court this morning.

Keith Chalk, from Worthing, appeared before Judge Thorpe to be sentenced for five counts of selling cannabis and cannabis resin to undercover police.

The offences occurred on 27th June 2003, when undercover police, with video recording devices, entered Buddies, a Dutch- Style cannabis cafe, in Worthing. The purchased various bags of cannabis totalling 13.26grams in total.

The prosecution mentioned Keith's previous record of cannabis offences and applied for £578 in prosecution costs.

Defence barrister Richard Meredith mentioned the exemplary character witnesses provided and the pre-sentence report. Judge Thorpe replied that Mr Meredith was talking to an open door.

In sentencing, Judge Thorpe accepted that Keith's views on cannabis were his only crimes and said that there was enough mitigation to supply public interest.

He gave Keith credit for pleading guilty and acknowledged his clear intentions as a campaigner.

He said that there was nothing to be gained by a custodial sentence, and imposed a community service penalty of 160 hours.

He made no order for costs.

Judge Thorpe then said:

"On January 29th, the Parliament downgrade of cannabis takes place. I will be giving a written statement regarding this case, as it is such an important case. I do not condone the supply of cannabis but I have to take into consideration the Government decision to downgrade."

He also indicated that he and Judge Sessions had spoken about all the cannabis cafe charges, and that he had taken advice from Judge Sessions.

This is my report based on the notes I made in court

i cant believe it ??? a judge with sence.......

shame about the 160 hours community service though,as that is what he is trying to do anyway......

maybe the judge could give him a licence to trade as a coffee shop,so he could be a real

service to his community.......
