By: 680News staff and Canadian Press Toronto - Prosecutors are planning to launch a speedy appeal of a Toronto judge's ruling that Canada's marijuana possession laws are unconstitutional. Judge Howard Borenstein dismissed charges against a 29-year-old Toronto man, charged with possession of 3.5 grams of marijuana. The accused's lawyer, Brian McAllister, argued that the federal government made a policy under Health Canada's Marijuana Medical Act, which proposed regulations to provide pot for medicinal purposes, but never made it to law. The judge agreed that this brought all possession laws into question and dismissed the charges. Similarily this week, Liberal Senator Larry Campbell called for the decriminalization of marijuana, arguing that the government should tax it. Borenstein said he would wait two weeks before making the ruling official. Speaking with the CBC, McAllister said the ruling, if it stands, could carry with it "pretty big" ramifications.
