Man admits pain relief cannabis use

A MAN who used cannabis as pain relief has pleaded guilty to growing the class B drug in his Torquay flat.

Stephen Raines, 47, of Willow Avenue, had 29 cannabis plants growing in his utility and airing cupboards when police entered the premises with a drugs search warrant in December last year.

Magistrates sitting in Torquay were told Raines admitted the offence at the police station.

He said he did it because cannabis helps him deal with the pain he gets from a medical condition.

Raines suffers from a degenerative back condition called neurofibrosis and was prescribed medicinal cannabis by his doctor until the law was changed in late 2008.

Defence solicitor Paul Dentith said Raines used cannabis purely for medicinal pain relief.

He told the court Raines's doctor had been prescribing him with cannabis, but at the end of 2008 the law changed and doctors were no longer able to do this.

Mr Dentith said: "He found the cannabis had a greater effect at pain relief than the other drugs he had been given, and he was suffering from an increasing addiction to the opiate-based drugs he was taking." He added: "GPs were providing this drug when they felt it was appropriate, because of an anti-drugs campaign they can't.

"This is not one of those cases which warrants a penalty."

Raines was given a six-month conditional discharge and told he didn't have to pay any costs.

Sorry, but as someone with pretty much the same degenerative spinal scenario I have to say this is NO RESULT sad.gif
He has now got a criminal record, with all that that entails. Unemployable, limited travel options etc etc.
Plus he has no meds.
What result? He's a convicted criminal with a drugs rap. I can't feel anything but anger at this.

And what's with all this "Law change" - how does that work???

Got to agree with Arnie here. How can someone suffering an agravated burglary and then being dragged through the courts by the twats be classed as a result? mad.gif

we all live by laws of the land, whether they are right or wrong

the current law states weed illegal, so he broke the law

the court couldn't of given him anything less than he got other than a complete discharge and if they did that they wouldn't be doing their own job, which is upholding the current law, whatever it may be

i don't think its like saying go away and don't be ill anymore

i think the bench did the best they could tbh

which is unusual in itself ... so yes, i applaud them

it isn't their job to sit there and pronounce whether a law is fair or not

why didnt they just throw it out of court, they still branded him a criminal for using a medicine

The government don't seem to be. This man was convicted via an unlawful maladministration of the misuse of drugs act.
