This smirking crook was found slumped inside his car with bags of cannabis

 

He was already on a suspended sentence

A smirking man who was seen slumped inside a car in Derby was found to have a rucksack containing bags of cannabis.

Michael Smith pleaded guilty to possession with intent to supply cannabis and being in charge of a vehicle with excess alcohol.

Derby Crown Court heard how the 25-year-old appeared to be unconscious and there was a smell of alcohol and cannabis when police approached his car in Grampian Way, Sinfin, in February.

After carrying out a search, officers found a blue rucksack in his car which contained bags of the illicit drug.

The court heard how Smith had breached a suspended sentence when he committed this offence.

Judge Shaun Smith QC slammed the defendant for his actions and decided to impose a custodial sentence.

 

'The golden rule'


He said: "If I impose another suspended sentence it will have no teeth, they don't mean what they say. What's the point?

"When you commit further offences, the court does make custodial sentences. A suspended sentence means what it has got to mean.

"It didn't stop him committing these offences. The commission of further offences is always the golden rule."

 

What happened?


Lauren Butts, prosecuting, told the court the incident took place on February 24, at 5.15am.

She said: "Reports are made to the police of a male that is slumped in a car in Grampian Way. The car was not running.

"The male appears to be unconscious, but he was not unconscious. There is a smell of alcohol and cannabis.

"At the front of the vehicle, police find electric scales and £700 in cash."

Ms Butts tells the court that officers also found a blue rucksack which contained bags of cannabis.

Smith was interviewed and provided a prepared statement which said he parked his car in Gampian Way and went to his friend's house.

He drank alcohol while he was there and returned to the car to fall asleep. He was going to get up in the morning and walk home.

 

Looking after his mother


Denny Lau, mitigating, told the court that he had been stressed while looking after his mother.

He said: "You will see from the report that he looks after his mother who has mobility issues.

"He explained to me the stress of not being able to speak to his mother about the stress of looking after her."

 

What did he get?


Smith, of Grovebury Drive, Littleover, pleaded guilty to possession with intent to supply cannabis and being charge of a motor vehicle with excess alcohol.

He was handed 26 weeks in prison for the drug offence and 12 weeks for breaching the suspended sentence, giving him a total of 38 weeks in prison.

He was also disqualified from driving for three years and 19 weeks.

 3yrs and 19 weeks driving ban when he wasn't even driving?

If the keys were In the ignition they would have used it against him so I take it they weren't. ..

Im far from a fan of drink driving but fuck that's harsh.

Eta that blackhead on his nose would squeeze lovely. lol

Doesn't say what the suspended sentence was for. If it was for drunken driving, then my sympathy levels would fall.

If they weren't in the ignition he wouldn't of been in court for it unless they lied

£700 and 'bags of cannabis'. The guy looks well dangerous. 38k a year per prisoner so this chaps going to be costing us all 28k. Add a bit more on cos his mum will now need a paid carer. Solid result- beers all round I'm sure , well worth the time and effort.  We will probably expung his record in 5 years...:wallbash:
